Debt Collecting 

All businesses suffer from people who won't or can't pay their debts. Collecting money due can make the difference between profit and loss. We will help you get payment if possible, and will also try to recover interest and costs from the debtor. If it becomes necessary to issue court proceedings against the debtor the matter can proceed in a number of different ways. 

Small claims procedure 

If the amount you are looking to recover is less than £5000, your claim will be dealt with under the small claims procedure. This is quick and informal, and the matter will be heard before a district judge. 

Claims in the small claims track differ from larger claims in that the loser does not have to pay the winners costs. If you win the claim, you will not recover your costs, although you should recover court fees, expenses of attending court and a small fixed sum towards your solicitors costs. 

The small claims procedure is designed for people to represent themselves, although we will be glad to represent you if you wish, and in most cases will agree our costs beforehand. If you wish to represent yourself, we can help you consider the evidence and advise you on the merits of your case and how to present it. 

Claims for sums greater than £5000 

If you succesfully bring a claim for a sum greater than £5000, you will, in most cases, recover your costs from the losing party. The costs will be assessed by the court if they cannot be agreed between the parties. There are some circumstances where you may not recover your costs even if you win, for example if the other party has Legal Aid. If the other party cannot afford to pay your costs straight away, you will usually be entitled to recover interest on your costs. 

Whilst we hope you would not lose your claim at trial, if you do you are likely to be ordered to pay your opponents costs as well as your own costs. It can also happen if you refuse an offer of settlement which the court considers to be reasonable. We can advise you on offers you receive so that you can make an informed decision.
