Cybersquatting1. I tried to register a domain name but it is already taken. Can I have it transferred to me?The procedure will depend on the type of domain – in particular whether it is a “.co.uk” or a “.com”. There are of course several other variations but these are generally the most used and so the most important.
A cybersquatting dispute involving a “.co.uk” domain can be dealt with Nominates or Dispute Resolution Service. Nominate is a non-profit organisation that maintains the register of “.co.uk” domain names and the Dispute Resolution Service is a fast and effective alternative to formal litigation in cybersquatting cases. It is not the only option and we can discuss the most efficient and cost effective way to secure your objective.
In the event of a “.com” dispute the relevant body is likely to be the non-profit internet naming company, ICANN.

There may be other routes to consider and the earlier you contact us the more likely it is that the widest possible range of options will be avaiable to you.
2. I have been approached with an offer to purchase a domain name that includes my trademark and/or business name. Should I buy it or am I entitled to it anyway? The important thing is for you to not get into correspondence with the would be seller as you do not want to jeopardise your position. Contact us and we can discuss the appropriate strategy.
3. I have registered and used my domain name but someone has registered a name very similar/an almost identical name with a “typo”. What can I do? This may follow similar lines to the answer to question 1 above. The cybersquatting strategy will depend on a number of issues such as the name used in the domain name and how similar is the “typo” version is to that name.
4. My domain name resolves to another site and I need to take urgent action. What should I do about cybersquatting? Again, swift action is key to a successful and effecient resolution in cases of cybersquatting. It may be that there are potentially criminal solutions that need to be considered and we have had cybersquatting cases in the past where we have involved the FBI. Common to all the above is the need for swift action to be taken. We work closely with industry experts who are able to capture huge amounts of on-line data very quickly so whilst there is the temptation to “read the riot act” to the infringed individual but it may well be to take no action until the evidence is stored in such a way that it can be used to prove your case. Sometimes, simple screen print outs will not be enough.
